SirenAI - AI Video Generation Platform

👤 1. Identity Match & Biometric Privacy

Identity Match Is Yours Alone: The reference photos you upload to anchor your identity (or any talent profile you create) are used solely to generate images of that profile, for your account. They are never shared with other users, never used to identify you outside the platform, and never used to train models that other users can access.
What "Identity Match" Stores: When you create a talent profile we derive (a) a personal LoRA — a small set of model weights tuned to your face/body, stored privately to your account, and (b) face embeddings — numerical fingerprints used by the face-refine step to keep your likeness consistent across wide-shot renders. These are derivative biometric data and are subject to the same protections as the original photos.
No Surveillance Use: Face embeddings and identity LoRAs are NEVER used for surveillance, facial-recognition search, matching against external databases, advertising profiles, or any purpose other than generating content you explicitly request. We do not share biometric data with law enforcement except as required by valid legal process.
No Cross-Account Bleed: Your identity LoRA cannot be loaded by another user's account. Per-account isolation is enforced at the database level and at the inference layer. We do not aggregate identity data across users, even in anonymized form.
Deletion Removes the Match: Deleting a talent profile from your account removes the reference photos, the trained LoRA, and the face embeddings from active storage within 30 days, and from backups within 90 days. Once removed, no new generations using that identity can be made — by you or by anyone.
You Authorized the Identity: By uploading reference photos you affirm that the depicted person has consented to AI generation of their likeness. Uploading photos of someone who has not consented is a violation of our Acceptable Use Policy and may carry legal consequences in your jurisdiction (BIPA, GDPR Article 9, CCPA, etc.).
Generated Likeness Is Your Responsibility: Outputs that depict your trained identity are content you create. We do not watermark, register, or claim rights in your generated likeness; we also do not police where you use it. Misrepresentation, impersonation, defamation, or non-consensual intimate content using anyone's likeness is forbidden by our terms regardless of who trained the model.

🔒 2. Data Ownership & Intellectual Property Rights

Creator Ownership: All uploaded media including but not limited to photographs, video recordings, audio files, biometric data, and likeness representations (collectively "Creator Content") shall remain the sole and exclusive property of the uploading creator/user ("Creator").
Derivative Works: Any AI models, embeddings, or trained neural networks derived from Creator Content ("Derived Models") are considered derivative works under intellectual property law and shall be subject to the same ownership rights as the original Creator Content.
Prohibited Use: Derived Models may not be shared, distributed, sublicensed, sold, transferred, or otherwise made available to third parties without express written consent from the Creator. Unauthorized use may result in immediate account termination and legal action.
License Grant: Creator grants SirenAI a limited, non-exclusive, non-transferable license to process Creator Content solely for the purpose of providing the video generation services requested by Creator.

💾 3. Data Storage, Security & Encryption

Encryption Standards: All Creator Content is encrypted at rest using AES-256 encryption and in transit using TLS 1.3 or higher. Encryption keys are managed using industry-standard key management systems.
Access Controls: Access to Creator Content and Derived Models is restricted to authorized personnel only through role-based access control (RBAC) systems with multi-factor authentication (MFA) requirements.
Data Isolation: Creator Content is logically isolated on a per-account basis and stored in secure, access-controlled storage systems with audit logging enabled.
Security Audits: Our security practices are subject to regular third-party security audits and penetration testing to ensure compliance with industry standards.
Breach Notification: In the event of a data breach affecting Creator Content, we will notify affected Creators within 72 hours of discovery in accordance with applicable data protection regulations.

📝 4. Usage Rights & Generated Content

Output Ownership: All generated outputs including images, videos, animations, and motion data created using a Creator's Derived Models ("Generated Content") are the exclusive property of the Creator who initiated the generation request.
Commercial Use: Creators retain full commercial rights to Generated Content and may use, modify, distribute, sublicense, or sell Generated Content without restriction or additional fees to SirenAI.
Platform Rights: SirenAI may collect and analyze anonymized, aggregated performance metrics and usage statistics (excluding the actual Creator Content and Generated Content) to improve model accuracy, system performance, and service quality.
No Content Monitoring: We do not monitor, review, or claim ownership over Generated Content unless required by law or to enforce our Acceptable Use Policy.
Attribution: While not required, attribution to SirenAI when publicly sharing Generated Content is appreciated.

🔐 5. Access Controls & Permissions

Permission Levels: Account administrators may assign granular permissions including: (i) view-only access, (ii) generate-only access, (iii) upload/edit access, or (iv) full administrative access to Creator Content and Derived Models.
Default Privacy: All Creator Content, Derived Models, and Generated Content are private by default. No content is shared publicly, with other users, or with third parties without explicit Creator authorization.
Shared Access: Creators may grant access to specific users or teams through our permission management system. All access grants are logged and auditable.
Access Revocation: Permission grants may be revoked at any time by the Creator or account administrator, with changes taking effect immediately.
Account Security: Creators are responsible for maintaining the confidentiality of their account credentials and for all activities under their account.

🗑 6. Data Deletion, Retention & Right to Erasure

Deletion Requests: Creators may request deletion of their Creator Content, Derived Models, and Generated Content at any time by contacting support@sirenai.co or through the account settings interface.
Deletion Timeline: Upon receipt of a valid deletion request, all requested data will be removed from active storage systems within 30 days. Backup systems will be purged within 90 days.
Permanent Deletion: Deleted data is subject to secure deletion procedures including cryptographic erasure and cannot be recovered once the deletion process is complete.
Model Deactivation: Upon deletion of Creator Content, any associated Derived Models are immediately deactivated and become unavailable for generation requests.
Retention Requirements: Certain metadata may be retained for legal compliance, fraud prevention, or security purposes as required by applicable law, but will not include actual Creator Content or Generated Content.

⚖ 7. Limitation of Liability & Disclaimers

Service "As-Is": The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Content Responsibility: Creators are solely responsible for ensuring they have all necessary rights, licenses, and consents for any content they upload to the Platform.
Limitation of Damages: To the maximum extent permitted by law, SirenAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Platform.
Maximum Liability: SirenAI's total liability for any claims related to the Platform shall not exceed the amount paid by Creator to SirenAI in the 12 months preceding the claim.
Generated Content Accuracy: We do not guarantee the accuracy, quality, or suitability of Generated Content for any particular purpose. Creators should review all Generated Content before use.

📜 8. Indemnification

Creator Indemnification: Creator agrees to indemnify, defend, and hold harmless SirenAI, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (i) Creator's use of the Platform, (ii) Creator Content uploaded to the Platform, (iii) Generated Content created by Creator, or (iv) Creator's violation of this Privacy Policy or applicable laws.
Third-Party Claims: Creator assumes all responsibility for third-party claims related to intellectual property rights, privacy rights, or publicity rights in Creator Content or Generated Content.

⚖ 9. Governing Law & Dispute Resolution

Governing Law: This Privacy Policy shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Jurisdiction: Any disputes arising from this Privacy Policy or use of the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
Arbitration: Parties agree to attempt to resolve disputes through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

🔄 10. Policy Modifications & Updates

Right to Modify: SirenAI reserves the right to modify this Privacy Policy at any time. Material changes will be communicated to Creators via email or in-platform notification at least 30 days before taking effect.
Continued Use: Continued use of the Platform after policy modifications constitutes acceptance of the updated Privacy Policy.
Version History: Previous versions of this Privacy Policy are available upon request to legal@sirenai.co.

By using this Platform, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy and Licensing Agreement. If you do not agree to these terms, please discontinue use of the Platform immediately.
